This Privacy Policy explains how Newburst Financial (“Newburst Financial,” “we,” “us,” or “our”), an independent insurance agency and tax services firm based in Valley Stream, New York, collects, uses, shares, retains, and protects your personal information. It applies to information collected through https://newburstfinancial.com (the “Website”), our quote forms, phone calls, email, and in-person appointments.
This policy is written to comply with applicable United States federal and state law, including:

- Internal Revenue Code Section 7216 and Treasury Regulation 301.7216, which restrict how tax return preparers use and disclose tax return information.
- The New York SHIELD Act (NY General Business Law Sections 899-aa and 899-bb) and the New York Department of Financial Services Cybersecurity Regulation (23 NYCRR Part 500), where applicable.

3. Your Consent and How We Use Your Information
We collect and store your personal information only after you give consent, and you may withdraw that consent at any time.
How we obtain consent. You give consent when you submit a quote form, sign a client engagement or authorization form, or agree verbally or in writing during an appointment. For tax return information, we obtain any separate written consent required by IRC Section 7216 before using or disclosing it for any purpose other than preparing your return.
How we use your information:
- To provide insurance quotes, compare carriers, apply for coverage, and service your policies and claims.
- To prepare and electronically file personal and business tax returns, process ITIN applications, respond to IRS notices, and provide bookkeeping and payroll services.
- To verify your identity and prevent fraud.
- To communicate with you by phone, text, or email about your request, appointment, policy, or return.
- To meet legal, regulatory, and recordkeeping obligations.
- To operate, secure, and improve our Website.
Marketing. We send marketing emails or texts only with your permission. Every marketing email includes an unsubscribe link, as required by the CAN-SPAM Act. We will not send autodialed or prerecorded marketing calls or texts without your prior express written consent, as required by the TCPA.
Withdrawing consent. You can withdraw consent by calling (888) 882-1582 or emailing us (Section 8). Withdrawal does not affect processing already completed, and we may be unable to continue a service that depends on the information.
4. How We Share Information
We do not sell, rent, or trade your personal information to anyone.
We share information only as needed to deliver the service you asked for, or as the law requires:
- Insurance carriers and underwriters — to obtain quotes, bind coverage, and handle claims for you.
- Tax authorities — the IRS and state tax departments, to file returns, ITIN applications, and responses you authorize.
- Service providers — e-filing software, secure document storage, email, payment, and IT providers who must protect your information by contract and may use it only for our services.
- Partner services you request — for example, business formation through our partner CorpNet or alarm systems through our partner, only when you choose those services.
- Legal requirements — to comply with a subpoena, court order, regulator request, or law, or to prevent fraud or protect rights and safety.
- Business transfers — to a successor if our agency is sold or merged, under the same protections in this policy.
Your GLBA rights. We share nonpublic personal information with nonaffiliated third parties only as permitted by GLBA exceptions, such as processing a transaction you requested. If we ever plan to share it in another way, we will notify you first and give you the right to opt out.
Tax return information. Under IRC Section 7216, we will not use or disclose your tax return information for any purpose other than preparing your return without your separate signed consent.
5. Data Retention, Deletion, and Email Notices
We delete your personal information 90 days after it is no longer needed, unless a law requires us to keep it longer.
90-day deletion. If you request a quote or consultation and do not become a client, or once a service is complete and no record is legally required, we securely delete your personal information and uploaded files within 90 days.
Legally required records. Some records must be kept longer. For example, IRC Section 6107 requires tax preparers to keep a copy or list of returns prepared for 3 years, and IRS e-file rules require keeping signed e-file authorizations (Form 8879) for 3 years. New York insurance regulations also require agencies to keep certain policy and transaction records. We keep only what these laws require, only for the required period, and then delete it.
Secure disposal. Electronic records are permanently erased, and paper records are shredded, consistent with the FTC Disposal Rule and the New York SHIELD Act.
Email notices to you. We email the person whose information we store, at the address you provide:
- A confirmation when we receive and store your information, describing what was collected and why.
- A notice when your information is deleted, or when it must be kept longer under law, with the reason.
- A notice of any data breach affecting your information, as required by New York General Business Law Section 899-aa and other applicable state laws.
We send these notices only to you, the individual whose data is stored, and never to anyone else.
6. Security
We protect your information with administrative, technical, and physical safeguards required by the FTC Safeguards Rule, including encryption, access limited to staff who need it, multi-factor authentication, secure file storage, and staff training. No system is perfectly secure, so please contact us right away if you suspect misuse.
7. Cookies, Children, and Your Rights
Cookies. The Website uses cookies and similar tools to keep it working and to understand site traffic. You can block or delete cookies in your browser settings; some features may not work without them.
Children. The Website is not directed to children under 13, and we do not knowingly collect their information online, consistent with COPPA. A parent or guardian may provide a dependent’s information for tax or insurance purposes.
Your rights. Subject to legal limits, you may ask us to:
- Access the personal information we hold about you.
- Correct inaccurate information.
- Delete your information before the 90-day period ends, unless the law requires us to keep it.
- Withdraw consent or opt out of marketing.
Residents of certain states, such as Connecticut or New Jersey, may have additional rights under state privacy laws to the extent those laws apply to us. We will verify your identity before acting on a request and respond within 45 days. We will not discriminate against you for exercising your rights.
Third-party links. Our Website links to partner sites, such as alarm system and business formation partners. Their own privacy policies apply.
8. Changes and Contact Us
We may update this Privacy Policy. We will post the new version here with a new effective date and email clients about material changes.
