Terms of Service
Last updated: October 2026 | Newburst Financial, Valley Stream, NY
1. Acceptance of These Terms
By using https://newburstfinancial.com (the “Website”) or our services, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Website.
These Terms are an agreement between you and Newburst Financial (“Newburst Financial,” “we,” “us,” or “our”), an independent insurance agency and tax services firm in Valley Stream, New York.
Eligibility. You must be at least 18 years old and able to enter a binding contract to request quotes or services. A parent or legal guardian may submit information on behalf of a minor dependent.
Separate agreements. Insurance policies are governed by the carrier’s policy documents, and tax or bookkeeping work is governed by a separate client engagement letter. If those documents conflict with these Terms, those documents control for that service.
2. Our Services
Newburst Financial is an independent agency that helps you find insurance from multiple carriers and provides tax and bookkeeping services; we are not an insurance company.
Insurance services. We help you compare and apply for auto, motorcycle, boat, ATV, home, condo, renters, landlord, life, and business insurance from more than 20 carriers. Quotes are estimates and are not an offer or a binder of coverage. No coverage exists until a carrier accepts your application and confirms it in writing. Coverage, eligibility, and premiums are decided by the carrier, not by us. We are licensed in the states where we sell insurance, and we may receive commissions from carriers for policies we place.
Tax and bookkeeping services. We provide personal and business tax preparation, ITIN processing, IRS notice responses, payroll, and bookkeeping. Our work depends on the accuracy and completeness of the information you give us. You are responsible for reviewing and signing your return, and you remain legally responsible for your tax obligations. We do not guarantee any specific refund amount or tax outcome.
Partner services. Business formation (through CorpNet) and alarm systems are provided by independent partners under their own terms. We are not responsible for partner services.
Website content. Articles, guides, checklists, and FAQs on the Website are general information only. They are not legal, tax, or insurance advice for your situation.
3. Your Responsibilities and Acceptable Use
You agree to give us true, complete, and current information and to use the Website lawfully.
Accurate information. Insurance applications and tax returns rely on what you tell us. Giving false or incomplete information may cause a carrier to deny a claim or cancel a policy, and may lead to IRS penalties. Knowingly submitting false information to obtain insurance may be insurance fraud under New York Insurance Law and other state laws.
Your authority. You may submit only your own information, or information about another person (such as a spouse, dependent, driver, or employee) that you are authorized to share.
You agree not to:
- Use the Website for any unlawful or fraudulent purpose.
- Upload files containing viruses, malware, or harmful code.
- Attempt to gain unauthorized access to the Website, its servers, or other users’ data.
- Scrape, copy, or reuse Website content for commercial purposes without our written permission.
- Impersonate another person or submit spam through our forms.
Intellectual property. The Website’s text, logos, graphics, and design belong to Newburst Financial or its licensors and are protected by U.S. copyright and trademark law. Carrier names and logos belong to their owners.
4. Communications, Privacy, and Data Consent
By submitting a form or engaging our services, you consent to us storing your information and contacting you about your request.
Data consent and storage. We store your personal information only with your consent and only for insurance and tax services. Information that is no longer needed, and not required by law to be kept, is deleted within 90 days. We email you, the person whose data is stored, to confirm what we hold and when it is deleted. Full details are in our Privacy Policy, which is part of these Terms.
Contacting you. You agree that we may contact you by phone, email, or text at the details you provide to respond to your request and service your account. Marketing messages are sent only with your separate consent, and you can opt out at any time by replying STOP to texts or using the unsubscribe link in emails. Message and data rates may apply.
Electronic records. You agree to receive notices, documents, and signatures electronically, as permitted by the federal E-SIGN Act and the New York Electronic Signatures and Records Act.
Uploads. When you attach files through the Website, send only documents needed for your request. Do not send full SSNs or bank details through unsecured email; ask us for a secure upload option.
5. Disclaimers, Limitation of Liability, and Indemnity
The Website is provided “as is,” and our liability is limited to the extent the law allows.
Disclaimer. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components, or that rates, carrier lists, or articles are always current. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Limitation of liability. To the fullest extent permitted by law, Newburst Financial and its owners, employees, and agents are not liable for indirect, incidental, special, or consequential damages arising from your use of the Website. Our total liability for any claim related to the Website is limited to $100. This limit does not apply to liability that cannot be limited under applicable law, or to obligations under a signed engagement letter or insurance producer duties owed to you by law.
Indemnity. You agree to indemnify Newburst Financial against claims, losses, and costs, including reasonable attorneys’ fees, arising from false information you provide or your violation of these Terms.
6. Governing Law, Changes, and Contact
These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-law rules.
Disputes. Any dispute about the Website or these Terms will be brought in the state or federal courts located in Nassau County, New York, and you consent to their jurisdiction. Nothing here limits any right you have to file a complaint with the New York Department of Financial Services or another regulator.
Termination. We may suspend or end your access to the Website if you violate these Terms.
Changes. We may update these Terms. The updated version will be posted here with a new effective date, and continued use of the Website means you accept it.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
